Accessory Dwelling Units permitted in Single Family Residential Zones


After 3.5 hours of discussion on Wednesday, the Board of Trustees closed the public hearing and voted 4 to 2 to adopt a local law amending the zoning code to permit accessory dwelling units in Single-Family Residential Zoning Districts. The Local Law as adopted can be found here.


The local law goes into effect once it is filed with the NY Department of State, which generally takes about 30 days.


As a pilot initiative, the zoning code amendment will be reviewed after 10 units are installed or one year, whichever comes first.


What does this mean for homeowners in Single-Family Residential Zones who would like to install an ADU on their property?

We have posted information on the webpage of the Housing Affordability Task Force, including answers to some of the questions we have received over the last five months about ADUs. ADUs can take different forms as illustrated in this graphic. The Building Department will soon post guidance for those who wish to apply for an ADU.


A brief summary of some of the regulations governing the installation of an ADU under the new law is listed below:


Number of units:

  • Only one ADU per lot is permitted for single-family dwellings. Multi-family dwellings in Single-Family Residential Zones are not permitted to have an ADU.


Owner Occupancy:

  • The property owner must reside on the property, either in the main dwelling or in the accessory dwelling unit, and must sign an affidavit attesting to adherence to the regulations before receiving a Certificate of Occupancy from the Building Department. Upon property transfer, subsequent owners will also be required to sign an owner's affidavit.


Size:

  • ADUs can be no more than 1,000 sf or 50% of the floor area of the main dwelling, whichever is less. In the Zones with smaller lots (R-5, R-7.5, and R-10), the ADU can have no more than one-bedroom. For all other Single-Family Residential Zones, ADUS can have no more than two bedrooms.


Parking:

  • Homeowners must have an additional off-street parking space designated for an ADU. This is in addition to the two off-street parking spaces for single family dwellings, which means a property owner must have three off-street parking spaces in order to install an ADU. For single-family dwellings north of 119 and south of Broadway, owners are required to have two off-street parking spaces.


Rental term:

  • If rented, the accessory dwelling unit lease cannot be less than 6 months.


Front Facing Entrance:

  • No new front facing entrances are permitted to accommodate an ADU.


Attached or Detached?


Attached

  • If installing an attached unit, within the current footprint of the main dwelling (eg attic or basement), the property owner must apply for a building permit and submit an application that complies with code requirements. If the required additional parking is not available on-site, the owner will have to apply to the Planning Board for site plan review. If the main building does not currently comply with code, in terms of setbacks or otherwise, the ADU cannot increase the height of the building and cannot increase the factor that is non-conforming.


  • If installing an attached unit that expands the main dwelling's footprint (e.g., as with an addition), the property owner may have to apply to the Planning Board for site plan review depending on the size of the expansion.


Detached

  • All detached units must comply with code.


  • The installation of a new detached unit is only permitted in the Zoning Districts with larger lots (R-80, R-60, R-40, R-30, R-20, R-15 - zoning map here). The installation of an ADU in an existing detached unit is permitted, but the structure must already comply with code, and in the case of a garage, if required parking spaces are removed, the owner must apply to the Planning Board for site plan review.

Action Items from the Jan. 25, 2023 Work Session:


Fireboat McKean Request for Home Port Status: For background on the request under consideration to designate the Tarrytown Marina as the home port for an application to the State Historic Preservation Review Board by the Fireboat McKean Preservation Project, please see the background information we posted on our website. The deadline for the Board of Trustees to respond was February 6, 2023. In order to maximize the time allotted to investigate the questions that arose, the Board took action at the January 25 Work Session. Because unanswered questions remained about when the harbor would be dredged by the private entity leasing the Tarrytown Marina from the Village, as well as about location, safety and access before a dredging project is completed, the Board of Trustees voted to submit a letter of objection to the State Historic Review Board. The letter was submitted on February 3rd. The State Office of Historic Preservation responded that the Fireboat's application would not be submitted to the National Historic Review Board until a different home port had been identified given the fact that, "The home port designation in a National Register Nomination must be accurate and current."


Washington Irving Boat Club Lease Extension: At the request of the WIBC, the Board of Trustees extended the lease for the Washington Irving Boat Club by twelve months, with a new expiration date of December 31, 2023.


Eastview Pump Station amended project estimate: Due to additional information about the complexity of asbestos abatement in the roof removal and replacement of the Eastview Pump Station, the project cost estimate submitted for the Restore NY grant application increased from $2,150,000 to $2,450,000. If awarded the grant funds, the Village would be responsible for project costs greater than $2million. These estimates were given by third party vendors for the purposes of the grant application, but if the Village were awarded the grant funds and were to move forward with the project, the project would be subject to public bidding as with any large project. The asbestos and hazardous materials abatement at the Eastview Pump Station would have to be taken care of whether the building is demolished or restored. The Village expects to hear back about the application in April.

Additional items from the BOT Meeting on February 8:


CSEA Stipulation of Agreement approved: The Board of Trustees approved the Stipulation of Agreement following a successful negotiation with the Civil Service Employees Association. The contract is retroactive to June 1, 2022.


MEBCO agreement approved: The Board of Trustees approved the signing of an Intermunicipal Agreement (IMA) with the Municipal Employee Benefits Consortium (MEBCO). The Village is pleased o be able to provide the same if not better health benefits, while realizing a cost savings for the Village and those employees contributing to premium payments.


Metal Detector declared surplus: The Village Court received a new metal detector through a state grant program, so the old one can be sold or donated.

Village News

Presidents Day on February 20, Village Offices Closed


Village Offices will be closed Monday, February 20th in recognition of Presidents Day. The Regular Board of Trustees Meeting will take place on Tuesday, February 21.


Con Ed Updates


It's a headache. We know. The good news, which we even hesitate to mention, is that due to the temperate weather this winter, the gas main replacement on Main Street is ahead of schedule.


Main Street: The gas main replacement work will continue between Baylis and White Street next week. The week of February 20th, the gas main replacement work will be primarily on Baylis, and not on Main.


While the gas main replacement continues at the western end of Main Street, the service connections to individual buildings will continue. In order to reduce the impact on businesses, Con Ed's contractor has been working at night between 7pm and 5am. They will not be doing night work on the weekends. For the most part, the service work connections do not involve loud noise, but occasionally, due to unforeseen circumstances when executing the work, a brief period of noisy disruption may be required as happened two nights ago. The contractors do their best to keep the nighttime disruptions to a minimum.


Main Street will be re-paved this spring. Prior to re-paving, Con Ed will be repairing sidewalks that have been compromised by the service connection work.


E. Sunnyside: The gas main replacement work is complete to Deertrack lane, the Tarrytown border. Residents living east of Deertrack Lane will continue to need to access their homes from Taxter Road.


Long term: We expect the sequence of gas main replacements to continue in the following neighborhoods (after Main Street is complete):

  • Franklin Street
  • Neperan between Hamilton and Broadway
  • Miller Park

Tuition Reimbursement Program for EMS AND Fire Volunteers


Citizen volunteers are often called on to respond to emergency situations in Westchester County. Due to a variety of factors, local volunteer fire departments and volunteer Emergency Medical Services (EMS) agencies are currently experiencing a critical need to recruit and retain members.


As an incentive for local residents to serve at volunteer fire departments and EMS agencies the Westchester County Department of Emergency Services (DES), has developed a program of recruitment and retention incentives for volunteer emergency services agencies. The program is designed to provide tuition or student loan reimbursement to volunteers for their service in the County.

Catskills FireTower Challenge 2023


Visit all six Catskill Fire Towers (Overlook, Hunter, Red Hill, Balsam Lake, Tremper, and Upper Esopus) between January 1, 2023 and December 31, 2023. Then fill out the log of completed hikes along with one favorite photo. The first 1,000 finishers will also receive a one-year subscription to the New York State Conservationist Magazine. To receive a bonus prize entry, submit a photo showing yourself practicing Leave No Trace™ while participating in the Catskills Fire Tower Challenge (e.g., picking up litter, carrying out, planning and preparing for their hikes, staying on trail, etc).

County Tax for Home Heating Suspended for Three Months


From the Examiner: "Westchester County officials announced last week that the county portion of the sales tax on home heating sources will be suspended for three months in hopes of giving beleaguered homeowners a break on energy prices amidst skyrocketing costs.


County Executive George Latimer said the 4 percent exemption will be in effect for three months, from Dec. 1 to Feb. 28, through the heart of the upcoming winter season. If a homeowner needs to fill a 250-gallon tank with heating oil at about $6 a gallon, for example, there would be a savings of about $60 with each delivery, he said."
